Financial Declarations in Divorce Cases are Important

Financial declarations are forms provided by the Utah court system in domestic cases. Filling out the forms and providing the supporting documents is important. Doing well on the financial declaration helps you and your attorney. 


Financial Declarations

Utah's courts have a financial declaration form for domestic cases. The form requests information on income, expenses, debts, assets, etc. Parties to a divorce case are required to fill out the form as much as possible, attach certain financial documents, and serve a copy of everything on the opposing party. If the court is to make a decision regarding alimony, child support, division of debts, possession or disposition of assets, or litigation expenses, the financial declaration and some of the financial documents served on the opposing party will need to be filed with the court directly.


Filling Out the Form Completely and Accurately Is Important

It is important to fill out the financial declaration form and provide the required documents as much as possible for at least two reasons. First, it enables the court to make a better decision. Leaving out information intentionally or unintentionally will lead to problems. For instance, if a litigant gets lazy and clumps all of his or her expenses under one heading in the expense section, the court may conclude that the expense is inflated, cut it, and give no credit for any other expenses. Second, filling out the form and providing the documents helps you build your case and gather evidence you will need for when you ask the court to make orders relating to finances.
